CartPath Studio is a service operated by Reagan-Dyer Holdings LLC.
Welcome to LeadOps, a software platform operated by CartPath Studio ("we," "our," or "us"). These Terms of Service govern your access to and use of our SaaS, website, and associated applications.
1. Service Description
LeadOps provides an integrated communications and lead-tracking platform allowing service businesses to organize incoming calls, web form submissions, text messages, and internal staff routing. The Service is provided on a subscription basis pursuant to an active agreement with CartPath Studio.
2. Acceptable Use
You agree to use our Services strictly for lawful purposes. The following behaviors are strictly prohibited:
- Transmitting unsolicited promotional or marketing blasts (spam) to individuals without verifiable consent.
- Attempting to collect or transmit highly sensitive personal health information (PHI) via SMS or unsecured channels.
- Impersonating any person or misrepresenting your affiliation with a business entity.
- Interfering with or disrupting the functionality, servers, or networks connected to the Service.
3. Customer Responsibilities
If you use LeadOps to communicate with end users:
- Opt-In Consent: You must secure direct, verifiable opt-in consent before messaging any individual.
- Honoring Opt-Outs (STOP): You must strictly and immediately honor all "STOP" or unsubscribe requests. Our platform mechanically stops texts upon a recognized "STOP" reply, and avoiding these mechanisms is a violation of these Terms.
- You are otherwise responsible for ensuring all communications comply with local and federal regulations (e.g., TCPA).
4. Disclaimers and Limitations of Liability
LeadOps is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose.
CartPath Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly as a result of using the Service or dropped communications due to carrier filtering or network issues.
5. Termination
We reserve the right to suspend or terminate your access to LeadOps immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Acceptable Use items defined in these Terms.
